DUI Third Offense Penalty in Virginia

Pursuant to Virginia Code 18.2-270, the penalty for a DUI third offense is:

1. 3^rd + Offense w/10 years – Class 6 Felony
   1. One to five years incarceration, or, up to 12 months jail and/or $2,500 fine
   2. 12 month suspended/restricted license
   3. 12 month VASAP, drug and alcohol free
   4. 6 month ignition interlock
   5. $1,000 fine mandatory minimum
   6. 90 days mandatory minimum, or if w/5 years, 180 days
