DUI Second Offense Penalty in Virginia

Pursuant to Virginia Code 18.2-270, the penalty for a DUI second offense is:

  1. 2nd Offense w/5 years – Class 1 Misdemeanor
    1. Up to 12 months jail and/or $2,500 fine
    2. 12 month suspended/restricted license
    3. 12 month VASAP, drug and alcohol free
    4. 6 month ignition interlock
    5. $500 fine mandatory minimum
    6. 20 days mandatory minimum
  2. 2nd Offense w/5-10 years – Class 1 Misdemeanor
    1. Up to 12 months jail and/or $2,500 fine
    2. 12 month suspended/restricted license
    3. 12 month VASAP, drug and alcohol free
    4. 6 month ignition interlock
    5. $500 fine mandatory minimum
    6. 10 days mandatory minimum
  • 2nd Offense w/10 years – Class 1 Misdemeanor
    1. Up to 12 months jail and/or $2,500 fine
    2. 12 month suspended/restricted license
    3. 12 month VASAP, drug and alcohol free
    4. 6 month ignition interlock
    5. $500 fine mandatory minimum
    6. >0.15 <0.20 – 10 days mandatory minimum
    7. >0.20 – 20 days mandatory minimum
